The Western District of Missouri typically assigns the first hearing date within two (2) to five (5) days after the motion is filed. Hearing results are provided the day of the hearing and orders are transmitted electronically the day they are received by Millsap & Singer, LLC

In order to file a proof of claim or a motion to terminate the automatic stay, we will require current payoff, current account status, copy of the note, and copy of the recorded deed of trust. An affidavit as to the mortgage status or account status is typically not required from the mortgage holder. If there is a dispute as to equity in the property, then appraisals, BPOs or other evidence of value may be required.
