Evictions in the state of Kansas are a judicial proceeding resulting from the foreclosure process.

foreclosure.
Upon expiration of the redemption period in Kansas, a Sheriff’s Deed is issued giving the purchaser
pursuant to the deed the right to possession of the property. A Writ of Assistance is filed with the
Court requesting that the occupants be forcibly removed from the property by the Sheriff’s Department.
Within days of the issuance of the Writ of Assistance, the move-out is scheduled and completed by the
Sheriff.
All personal property removed from the residence must be stored in a facility for a period of at least
30 days. At least fifteen days prior to the sale or disposal of the personal property, an advertisement
is to be placed in a legal newspaper indicating that the property will be sold or disposed. Optimally
the entire eviction process, including storage, and disposition of property, takes less than 47 days
to complete.
Whenever there is any personal property remaining in the property after the expiration of the redemption
period, Millsap & Singer, LLC recommends that an eviction be filed and that the personal property is
removed pursuant to a Writ of Assistance. This holds true even if the property appears to be
abandoned.
In order to initiate an eviction we require your written authorization to proceed. We also should have a
copy of the Sheriff’s Deed evidencing that a foreclosure has taken place and information as to the former
owner and occupants of the property.
